Revenue’s Tax and Duty Manual (section 07‑01‑09A) has been updated on 15 October 2026.

The amendment adds guidance on the interpretation of “sole purpose” in relation to foreign pension schemes.

What the amendment covers

Paragraph 2.1 of the manual now explains that an overseas pension arrangement must be established solely to provide retirement benefits. If the scheme permits access to benefits for any other purpose, it will not meet the “sole purpose” requirement of section 200A(1)(a) of the Taxes Consolidation Act 1997.

Why the clarification matters

The “sole purpose” test is used to determine whether a foreign pension lump‑sum is taxable in Ireland. A scheme that allows withdrawals for non‑retirement reasons could be treated as a taxable benefit, changing the tax position of the recipient.

  • Only schemes that are exclusively for retirement benefits satisfy the test.
  • Any additional access rights – for example, early cash‑out for non‑retirement needs – break the “sole purpose” condition.

How to interpret the guidance

When reviewing a foreign pension arrangement, check the scheme rules to see if they allow withdrawals for purposes other than retirement. If they do, the arrangement will not meet the “sole purpose” requirement and the lump‑sum may be subject to Irish tax.

Taxpayers can refer to the updated manual for the full wording of paragraph 2.1 and to the relevant sections of the Taxes Consolidation Act 1997 for the legal framework.
